JUPITER, Florida — In Episode 44 of the AGM Attorney Podcast, host Josh Konigsberg welcomes Alex Gertsburg, Managing Partner of Gertsburg Licata Co., LPA, Founder of ExitPath Partners, and creator of Cover My Six®. A business attorney, entrepreneur, Army veteran, author, and advisor, Gertsburg has spent more than 25 years helping business owners and professional service firms protect, grow, and successfully transition their businesses through legal strategy, risk management, and succession planning.

Throughout the episode, Konigsberg and Gertsburg explore why many attorneys spend years building successful law firms without creating businesses that are truly transferable or positioned for long-term enterprise value. Their conversation covers practical strategies for succession planning, leadership, legal risk management, operational efficiency, and the growing impact of artificial intelligence on the future of law firms.

Episode Highlights

  • Why succession planning should begin years before an attorney intends to retire, allowing firm owners to maximize enterprise value instead of rushing into a sale
  • How emotional intelligence directly impacts business growth, influencing leadership decisions, hiring, negotiations, and long-term strategic planning
  • Why many attorneys unintentionally limit the value of their firms by remaining indispensable to daily operations instead of building scalable systems
  • How proactive legal risk management reduces costly litigation, helping business owners prevent disputes before they become expensive lawsuits
  • Why recurring revenue, operational systems, strong branding, and marketing all contribute to higher firm valuations when preparing for an eventual transition or acquisition
  • How artificial intelligence is reshaping the legal industry, creating opportunities for firms willing to embrace new technologies while widening the gap between firms that innovate and those that resist change
  • Why surrounding yourself with advisors who possess complementary expertise is one of the fastest ways to overcome blind spots and accelerate business growth
  • How law firm owners can define their ideal exit today, then reverse engineer the decisions necessary to achieve greater freedom, profitability, and long-term success

The discussion emphasizes that building a valuable law firm extends well beyond practicing law. According to Gertsburg, owners who intentionally develop systems, leadership, recurring revenue, and operational efficiencies create firms that become significantly more attractive to future buyers while also improving their quality of life today: “The best time to start planning your exit is today. Enterprise value isn’t built at the closing table—it’s really built five to ten years before you plan to transition from your practice.”

Gertsburg also explains that one of the greatest barriers preventing attorneys from maximizing the value of their firms is not a lack of legal expertise, but what he describes as a “failure of imagination.” Rather than trying to solve every challenge themselves, he encourages attorneys to surround themselves with experts in marketing, operations, finance, succession planning, and technology who can help unlock growth opportunities they may never have considered. “You overcome a failure of imagination by surrounding yourself with people who are smarter than you in the areas that matter most.”

Another major theme of the episode centers on proactive leadership. Drawing on both his military experience and decades advising entrepreneurs, Gertsburg shares how emotional intelligence, adaptability, and preparation consistently outperform reactive decision-making when businesses encounter inevitable challenges: “Every entrepreneur faces obstacles. The firms that thrive are the ones that prepare before problems arrive instead of reacting after they happen. That’s why I developed CoverMySix.”

The conversation also explores proactive legal risk management through Gertsburg’s Cover My Six® framework. Rather than waiting until a lawsuit arises, he encourages business owners to identify potential vulnerabilities early and implement preventive measures such as stronger contracts, dispute resolution procedures, employee policies, and operational safeguards. According to Gertsburg, prevention is almost always less expensive—and less disruptive—than litigation: “Reactive legal strategy is expensive. Smart businesses identify risks early and solve them before they become lawsuits.”

Gertsburg explains that one of the most overlooked aspects of building a successful law firm is thinking beyond today’s revenue and considering what makes a practice attractive to future buyers. He encourages attorneys to shift their mindset from operating solely as legal practitioners to becoming business owners who intentionally build transferable value. By focusing on recurring revenue, operational systems, leadership development, and strategic planning, law firm owners can create firms that continue to thrive long after they step away from daily practice. “Most attorneys build great practices. Building a great business requires thinking differently about enterprise value.”

Artificial intelligence is another major focus of the episode. Gertsburg discusses how firms embracing AI are becoming significantly more efficient, improving client service while increasing profitability. Rather than viewing AI as a threat, he believes attorneys should see it as a competitive advantage that will increasingly separate market leaders from firms that resist technological change. “The firms adopting AI today are creating efficiencies that directly increase enterprise value tomorrow.”

Throughout the interview, Konigsberg and Gertsburg repeatedly return to one central message: successful law firms are built intentionally. Growth, profitability, leadership, succession planning, and exit strategy should never be treated as independent initiatives. When aligned, they create firms that are more valuable for owners, employees, clients, and future successors alike. Gertsburg notes, “Success isn’t just building a profitable firm. It’s building one that creates freedom, serves clients well, becomes self-managing and ultimately has lasting value.”

Regarding appearing on the AGM Attorney Podcast, Alex Gertsburg added, “I’ve done a lot of podcasts, and this was one of the most enjoyable. Josh asks thoughtful questions, creates great conversations, and genuinely wants to help his guests succeed.”
